Introduction

These Terms of Service ("Terms") govern your use of the GigReady website and platform located at gigready.band (the "Service"), operated by GigReady ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

Account Terms

• You must be at least 13 years old to use the Service.
• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account and password.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.
• One person or legal entity may maintain multiple accounts for different bands.

Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or threaten other users
• Send spam or unsolicited communications through the Service
• Attempt to gain unauthorized access to other accounts or systems
• Interfere with or disrupt the Service or its infrastructure
• Scrape, crawl, or use automated means to access the Service without permission

Your Content

You retain ownership of all content you submit to the Service, including band profiles, song information, setlists, images, and notes ("Your Content").

By submitting content to the Service, you grant us a limited, non-exclusive license to store, display, and process Your Content solely as necessary to provide and improve the Service. This license ends when you delete Your Content or your account.

You are solely responsible for Your Content and represent that you have the rights to submit it. We do not claim ownership of Your Content.

Public Band Pages

Bands may have public-facing pages (e.g., yourband.gigready.band) that display band information, upcoming shows, and booking forms. By enabling a public band page, you consent to that information being publicly accessible.

Payment and Billing

Certain features of the Service require a paid subscription. Payments are processed by Stripe.

• Subscriptions are billed monthly or annually, depending on the plan you choose.
• You authorize us to charge your payment method on a recurring basis.
• You can cancel your subscription at any time through the billing settings. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial billing periods unless required by law.
• We reserve the right to change pricing with 30 days' advance notice.

Free and Paid Tiers

We offer both free and paid tiers of the Service. Free accounts may have feature limitations. We reserve the right to modify the features available in each tier at any time.

Intellectual Property

The Service and its original content (excluding Your Content), features, and functionality are owned by GigReady and are protected by copyright, trademark, and other intellectual property laws.

The GigReady name, logo, and all related marks are trademarks of GigReady. You may not use these marks without our prior written consent.

Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users.

You may delete your account at any time. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIGREADY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL ARISING OUT OF YOUR USE OF THE SERVICE.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless GigReady and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
